Correcting The Record, A Statement In Regards To Cease & Desist Letters

Categories:

ON THE RECORD STATEMENT FROM LANNY J. DAVIS, ATTORNEY FOR F-FACTOR IN RESPONSE TO BUSINESS INSIDER ARTICLE ON THE COMPANY’S ISSUANCE OF CEASE & DESIST LETTERS

“The Cease & Desist letters were sent out to several people who were part of a targeted smear campaign against Tanya Zuckerbrot and her company, F-Factor through 2 anonymous Instagram sites. Since the letters were sent out those 2 anonymous Instagram sites were taken down. One of the recipient’s lawyers actually called and admitted that his client was involved and would cease all online activity disparaging F-Factor and Ms. Zuckerbrot. We also want to clarify that Cease & Desist letters are not abusive or threatening, they are merely legal letters telling the recipients that if they continued making ‘false, defamatory or disparaging comments’ that they would be held accountable for any damages caused by their conduct. By definition, they are not “litigious.”  Nor are they about thwarting first amendment expression or criticism of a company or products.  They are asking for personal scurrilous, false and misleading statements to cease.  Period.”
